The Edit

Terms of Service

Effective 31 October 2026

These terms are the agreement between you and us for the use of The Edit at theedit.one. Please read them before you sign in: by creating an account or using the service you accept them. If you do not agree, do not use the service.

1.Who we are

The Edit (the “service”) is provided by Sparing Interactive Adrian Holota, Al. Jerozolimskie 47/8, 00-697 Warszawa, Poland, NIP 7532358295 (“we”, “us”). You can reach us at hello@theedit.one.

These terms are our terms and conditions for services provided electronically within the meaning of the Polish Act of 18 July 2002 on the provision of services by electronic means. They are available free of charge at theedit.one/terms, where you can read, save and print them at any time.

In these terms, “you” means the person using the service. A “consumer” is a natural person using the service for purposes unrelated to their trade, business or profession; where these terms say consumers, this also covers sole traders for whom the agreement has no professional character, to the extent Polish law gives them the same protection.

2.The service

The Edit lets you upload photographs, arrange up to thirty-six of them per album into magazine-style layouts with text, read the result and, if you choose, share it through a link. We may add, change or remove features over time.

Using the service is free. Some features, such as the AI Assistant, use credits. Every account gets credits when it is made; a paid plan also brings credits at the start of every month, which lapse when the month ends. The others stay while your account exists. Credits can also be earned for activities described in the service, such as inviting friends or sharing albums, on the conditions shown there, which we may change for the future. Credits have no cash value and cannot be transferred, exchanged for money or refunded on their own. We may remove credits obtained by abusing the service.

The free plan is called Amateur. Enthusiast is a subscription that brings more credits, and packs of credits can be bought on their own. Their prices, including VAT, are shown on the Pricing page and before you pay. Payments are made through Stripe Checkout and sold through Link (operated by Stripe), which charges you, sends your receipts and handles refunds under its own terms of sale; those terms also describe your rights as a consumer, including any right of withdrawal. Enthusiast renews automatically for the same period until you cancel it, which you can do at any time; it then runs to the end of the period you paid for. We will never charge you without your explicit agreement, and we will tell you in advance of any change to the price of a subscription you hold.

Some features, such as additional layouts, typefaces and tools, or export to Instagram and Reels, are available only on paid plans. On the free plan you can try them while making an album, but sharing, publishing or exporting an album that uses them requires a paid plan, or replacing them with features of the free plan. The free plan always lets you make, share and keep complete albums. Albums you have shared stay shared if your paid plan ends; changing them with features of a paid plan, or sharing them anew, needs that plan again.

To use the service you need a device with an up-to-date web browser with JavaScript and cookies enabled, an internet connection and an email address. Editing albums requires a screen at least 1024 pixels wide. Using the internet carries general risks, such as malware or unauthorised access; keeping your device and email account secure is your responsibility.

3.Your account

You must be at least 16 years old to create an account. If you are under 18, you confirm that your parent or legal guardian agrees to your use of the service.

You sign in with a one-time link or code sent to your email address. Anyone with access to your inbox can sign in as you, so keep it secure and tell us at once if you suspect someone else has used your account. You are responsible for what happens in your account unless it happened without your fault.

The agreement is concluded when your account is created and lasts for an indefinite period. You may end it at any time, without giving a reason and at no cost, by asking us at hello@theedit.one to delete your account. We will delete it within 30 days of the request.

4.Your content

Your photographs, texts and albums (“your content”) remain yours. We do not claim ownership of them.

So that we can run the service, you grant us a non-exclusive, worldwide, royalty-free licence to store, copy, resize, convert, cache, display and transmit your content, and to let our service providers do the same on our behalf, solely to provide the service to you and to the people you share with. The licence covers the fields of exploitation needed for this: recording and reproducing in computer memory and on servers, and making available on the internet to the extent you choose. It ends when you delete the content or your account, except for copies kept for the limited time described in the Privacy Policy (for example in backups) or that we must keep by law. We will not sell your content, use it in advertising, or use it to train machine-learning models.

By uploading or sharing content, you confirm that:

  • you hold the copyright in it or have every permission needed to upload it and to grant the licence above;
  • every identifiable person shown in it has agreed to the way you use their image, where the law requires that consent;
  • it does not break the law or these terms.

You are solely responsible for your content and for whom you share it with. We do not review content before it is uploaded or shared, and we have no general obligation to monitor it.

5.What you must not do

You must not use the service to upload, store or share content that:

  • sexually exploits or endangers children in any way, or is intimate or sexual imagery of a person made or shared without their consent;
  • infringes anyone’s copyright, trade mark, image rights, privacy or other rights, or discloses another person’s personal data without a legal basis;
  • is unlawful, threatening, harassing, defamatory, or incites violence, terrorism, hatred or discrimination;
  • contains malware or anything designed to harm a device or system.

You must also not:

  • try to gain access to other people’s accounts or content, or to parts of the service not meant for you;
  • probe, scan or test the vulnerability of the service, or interfere with its operation, for example by overloading it;
  • use bots, scrapers or other automated means to access the service, except as the service itself provides;
  • use the service as general file storage or a content-delivery network, or resell or provide it to third parties as your own;
  • copy, decompile or reverse-engineer the service, except where the law expressly allows it.

6.Sharing

Albums are private by default. If you turn on a share link for an album or your library, anyone who has the link can view it, without signing in, until you turn the link off. Share links are kept out of search engines, but people you send them to can pass them on, and anyone viewing can take screenshots or otherwise copy what they see. We cannot control or undo copies made by others. Share only what you are comfortable with those people seeing.

7.Reporting content and moderation

Anyone can tell us about content on The Edit that they believe is illegal or breaks these terms by writing to hello@theedit.one. This address is also our single point of contact for users and for authorities under the EU Digital Services Act; you can write to us in English or Polish. To help us act, please include the share link or another precise location of the content, an explanation of why you consider it illegal, your name and email address (unless the report concerns child sexual abuse material), and a statement that you believe in good faith that the report is accurate and complete.

We handle reports promptly, carefully and objectively, and tell the reporter what we decided. If we receive a valid report, or otherwise learn of illegal content or a breach of these terms, we may disable a share link, remove or block access to content, or suspend or close an account. Our decisions are made by people, not by automated systems. When we restrict your content or account, we will tell you what we did and why, unless the law prevents it or the content is clearly part of deceptive or harmful spam. You may ask us to reconsider by replying to that message, and you may also take the matter to a court or an out-of-court dispute settlement body. Where the law requires it, we report suspected crimes to the authorities.

8.Suspension and termination

We may suspend your account or end the agreement with immediate effect if you seriously or repeatedly break these terms, in particular section 5, or if the law or an authority requires us to. In other cases of breach, we will first ask you to stop, and may end the agreement with 14 days’ notice if you do not.

We may stop providing the service altogether. If we do, we will tell you by email at least 30 days in advance, so that you have time to save your work.

When the agreement ends, we delete your account and content as described in the Privacy Policy. Sections that by their nature should survive termination, including 4 (for copies we may lawfully keep), 9, 10 and 13, continue to apply.

9.Availability and your copies

We work to keep The Edit available and your content safe, but we do not promise that the service will be uninterrupted, error-free or available at any particular time. We may interrupt it for maintenance, updates, security or reasons beyond our control. Where we can, we will plan maintenance for quiet hours.

The Edit is a place to edit and present your photographs, not an archive or backup. We store only resized copies of your photographs, never the original files. Always keep your originals and your own copies elsewhere.

10.Liability

We are liable for failing to perform the agreement under the general rules of Polish law, subject to the following.

We are not liable for:

  • your content, and content uploaded or shared by other users;
  • what people you share links with do with them or with what they see, including copying and passing them on;
  • unauthorised access to your account resulting from access to your email inbox or device, or from other circumstances for which we are not responsible;
  • interruptions or loss caused by force majeure, attacks on our or our providers’ systems, failures of the internet or of services outside our control, or by your breach of these terms;
  • loss of content you deleted yourself, or that you could have avoided by keeping your own copies as section 9 asks.

If you are not a consumer, the service is provided “as is”, and to the fullest extent the law allows: we give no warranties of any kind, statutory warranty (rękojmia) is excluded, we are not liable for lost profits, lost data or indirect damage, and our total liability to you is limited to 100 PLN.

Nothing in these terms excludes or limits our liability for damage caused intentionally, liability for personal injury, or any other liability or consumer right that cannot be excluded or limited under the law that applies to you.

You are liable to us for damage caused by your breach of these terms, including claims brought against us by third parties because of your content. If you are not a consumer, you will also indemnify us against those claims and the reasonable costs of defending them.

11.Our rights

The service — its software, design, layouts, typography, texts and the The Edit name and marks — belongs to us or our licensors and is protected by law. These terms give you the right to use the service as intended, for your own purposes, and nothing more. Typefaces are licensed from Adobe Fonts for use within the service only.

If you send us ideas or feedback, we may use them freely and without any obligation to you.

12.Complaints

If something does not work as these terms describe, write to hello@theedit.one and tell us what happened, when, and the email address of your account. We will reply within 14 days. If you are a consumer and we have not replied in that time, your complaint is deemed accepted.

If you are a consumer, you may also use out-of-court ways of resolving disputes, such as mediation by the Provincial Inspectorate of Trade Inspection (Wojewódzki Inspektorat Inspekcji Handlowej) or the help of a district (municipal) consumer ombudsman. Using them is voluntary for both sides.

13.Law and disputes

These terms are governed by Polish law. If you are a consumer, this does not deprive you of the protection given to you by the mandatory provisions of the law of the country where you have your habitual residence.

Disputes with consumers are resolved by the courts that have jurisdiction under the law. Disputes with anyone else are resolved by the common court with jurisdiction over our registered address in Warsaw.

14.Changes to these terms

We may change these terms for important reasons: a change in the law or in a decision of an authority, a change in how the service works or what it offers (including the introduction of paid plans), security or the prevention of abuse, or a change in our providers or our business details. We will email you about changes at least 14 days before they take effect and publish the new version here. If you do not agree, you may end the agreement before the changes take effect by asking us to delete your account; otherwise the new terms apply from that date. Changes that are only to your benefit, or that the law requires immediately, may take effect sooner.

15.Final provisions

These terms are available in English and in Polish. Both versions have the same content; if they differ, the Polish version prevails for consumers habitually resident in Poland, and the English version for everyone else.

If any part of these terms is found invalid or unenforceable, the rest remains in effect. Our not enforcing a provision is not a waiver of it. You may not transfer your rights or obligations under these terms without our consent; we may transfer ours to a successor running the service, in which case we will tell you in advance and you may end the agreement.

How we handle your personal data is explained in our Privacy Policy.
